    The TR1 form is the legal record that confirms the change in ownership when a house is sold to a new owner. It tells the Land Registry that you’re selling your home (or any formal interest in the property). 

    All the necessary details are covered in the TR1 form, including the identities of both seller and buyer, the description of the property being transferred, and the agreed financial terms. 

    When does a TR1 form need to be completed?

    A TR1 form is required whenever there is a change in the legal title of a property, which happens when selling your home. The form will need to be filled in ahead of completion day, so that the legal transfer of ownership can take place. 

    What happens after a TR1 form is signed?

    Once both the buyer and seller have signed the TR1 form, the next step is to have the form officially registered with the Land Registry, which is done by the buyer’s solicitor. The Land Registry then checks all the documents to ensure there are no discrepancies and, once verified, the details are updated in the official register. Both parties are informed of the successful update, and the buyer receives the new title deed as proof of ownership.

    How does a TR1 form work?

    The TR1 form is the formal agreement between the buyer and the seller, and it details the transaction by outlining the details of the property, the seller(s) and buyer(s), and the terms of the sale including any financial considerations. Both parties sign the form to show their agreement, then the form moves into the registration phase with the Land Registry.

    Do I need a solicitor to sign a TR1?

    No, you do not need to have a solicitor, or other legal advisor, to be involved at any stage of submitting a TR1 form, but it is generally recommended to have one. If your sale has any complex elements (like shared ownership, boundary disputes or other legal nuances) a solicitor’s guidance is useful and they can make sure your interests are protected. They’ll also check that the form is properly completed and all the documentation is as it should be, which can prevent delays or complications.

    Can things go wrong with a TR1 form?

    Yes, sadly things can go wrong.  Your solicitor will know the importance of a TR1 form, so will take the necessary care to make sure all the information is correctly provided when it is required.  But there are plenty of examples where errors have occurred and these can delay a sale, or worse can affect your ownership rights in your new home.

    • Misidentification of parties: The full names of the transferors (sellers) and transferees (buyers) – including any middle names – is essential.  If the names differ from the property title deeds, then further evidence (like a deep poll or marriage certificate) might be needed before Land Registry will recognise the transfer.
    • Mismatch with the contract of sale: The details in the TR1 must match the contract of sale as it reflects the terms agreed between buyer and seller.
    • Mismatch with the Title: If the TR1 differs from the Title then more information will be needed before ownership can be established.
    • Missing/wrong witness signature: If the signatures haven’t been witnessed by an independent adult not involved in the transaction, then this will invalidate the TR1.
    • Problems getting signatures: If an ex-partner is involved it can sometimes be difficult to get them to sign the form.  When this happens, a court order is often the only way forward adding cost and time to the process. 
    • Problems with Land Registry: Registering ownership should only take 4 – 6 weeks, but well documented delays at Land Registry mean it can take between 6 – 12 months, particularly where it is the first time a title is being registered on a new build property.
